1. Acceptance of Terms

By accessing and using Fluid Live Chat ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our live chat moderation service for YouTube livestreams, operated by Funcode SRL ("we," "us," or "our").

2. Description of Service

Fluid Live Chat is a web-based service that provides automated moderation tools for YouTube live chat streams. Our service includes:

• Real-time chat monitoring and moderation
• Automated spam and inappropriate content detection
• Custom moderation rules and filters
• Integration with YouTube's live chat API
• Analytics and reporting features

3. User Accounts and Registration

To use our Service, you must:

• Have a valid Google account associated with your YouTube channel
• Be at least 13 years old (or the minimum age in your jurisdiction)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for commercial purposes beyond your subscription plan
• Reverse engineer, decompile, or disassemble the Service

5. YouTube API Services

Our Service integrates with YouTube API Services. By using our Service, you also agree to be bound by:

You can revoke our access to your YouTube data via the Google security settings page.

6. Subscription and Payments

Our Service operates on a subscription model:

• Subscription fees are charged in advance on a recurring basis
• Payments are processed securely through Stripe
• All fees are non-refundable except as required by law
• We reserve the right to change our pricing with 30 days notice
• You can cancel your subscription at any time through your account settings

Failure to pay applicable fees may result in suspension or termination of your access to the Service.

7. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of your content and data. We only access and process your YouTube live chat data to provide our moderation services.

8. Service Availability

We strive to maintain high service availability, but we do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical difficulties
• Third-party service outages (YouTube API, etc.)
• Force majeure events

We will make reasonable efforts to provide advance notice of scheduled maintenance.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Funcode SRL and its licensors. The Service is protected by copyright, trademark, and other laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without prior written consent.

10. Limitation of Liability

In no event shall Funcode SRL, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Funcode SRL and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

13. Governing Law

These Terms shall be interpreted and governed by the laws of Romania, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
